GENERAL TERMS AND CONDITIONS
1. General information
1.1 DIGITAL CONTENT & MEDIA PRODUCTS
These Terms and Conditions (“Terms”) set forth the general terms under which we deliver content, products, or services listed on www.passengerguard.com (the “Website”), via our applications (the “Apps”), or by other means (collectively referred to herein as the “Products”).
Please read these Terms carefully before ordering any products through the Website or third-party app stores (such as the Apple App Store, Google Play Store, etc.).
The terms “PassengerGuard,” “we,” or “us” refer to PassengerGuard UG (haftungsbeschränkt). The term “Device” refers to any device used to access the Products, including, but not limited to, computers, smartphones, and tablets. The term “you” refers to the user of the Products.
By ordering or otherwise accessing or using the Products, you agree to be bound by these Terms and all applicable laws, rules, and regulations.
You may also be required to click “I accept” before purchasing access to the Products. If you do not click “I accept,” you may not be able to complete such a purchase or gain access.
By using the Products, you indicate that you accept these Terms and agree to abide by them. If you do not agree, please refrain from using the Products.

1.2 DISPUTE RESOLUTION / EQUITABLE RELIEF
In the event of any dispute arising out of this agreement, both parties agree to make commercially reasonable efforts to resolve the dispute in good faith.
If the dispute cannot be resolved within sixty (60) days, either party may submit the matter to binding arbitration under the rules of the BC International Commercial Arbitration Centre before a single arbitrator.
Arbitration costs will be shared equally, but each party shall bear its own legal fees. The arbitrator shall not award punitive or exemplary damages or provide remedies beyond those allowed in these Terms.
The arbitrator’s decision shall be final and binding. Judgment on the award may be entered in any court with jurisdiction. No claim may be brought more than twelve (12) months after the cause of action arose.
Equitable Relief: You acknowledge that any breach of these Terms could result in irreparable harm to PassengerGuard. Accordingly, PassengerGuard shall have the right to seek injunctive relief without the need to prove actual damage.
1.3 LICENSE BASIS
(a) These Terms and any Order constitute the entire agreement between you and us concerning delivery of the Products. You may be required to agree to additional terms to access certain content or features. If these additional terms conflict with these Terms, the additional terms will take precedence.
(b) Please ensure that the information in these Terms and in your Order is accurate. If you believe there is an error, request written confirmation of any changes. We only accept responsibility for written statements made by an authorized officer of PassengerGuard.
(c) By using the Products, you expressly consent to the processing and storage of your personal data in the United States and Canada, including data relating to payments and usage of the Products.
You understand and agree that the level of protection for personal data in the United States and Canada may not be equivalent to that of your country of residence.
1.4 CHANGES TO TERMS
PassengerGuard reserves the right to update or change these Terms or any other policies at any time. Users will be notified of such changes by the posting of updated Terms on this page.
Changes are effective immediately upon posting on www.passengerguard.com.
Your continued use of the Products constitutes acceptance of the revised Terms.
We may also notify you via in-app notifications, pop-ups, or emails.
2. SUBSCRIPTIONS AND PURCHASES
2.1 SUBSCRIPTIONS AND PURCHASE OPTIONS
(a) Registered PassengerGuard users may access the Products after creating an account. You can unlock premium content in the app by purchasing a subscription either through our Website or through an app store.
PassengerGuard offers five different types of paid subscriptions, providing access to various app features. The Premium subscription includes full access to all content and features, whereas the free version grants limited access only.
If you purchase a subscription via the Apple App Store or our iOS application, the sale is final, and no refunds will be issued. Purchases are subject to Apple’s applicable payment policy, which may not allow refunds.
If you purchase a subscription via the Google Play Store, the sale is also final and non-refundable, subject to Google’s payment policies.
(b) PassengerGuard offers monthly and yearly subscriptions, as well as a lifetime access purchase.
For the purpose of subscription durations:
- A “month” equals 30 calendar days
- A “year” equals 365 calendar days
- “Lifetime” equals 100 years or until PassengerGuard Media ceases to commercially offer the Products.
(c) Monthly subscriptions are billed on a recurring monthly basis. By subscribing, you authorize PassengerGuard to charge the same credit card or payment method used for the initial subscription each month until you cancel.
To avoid being billed for the next month, you must cancel your subscription before it renews. Partial-month refunds are not available.
(d) Yearly subscriptions are billed once upfront and renew automatically every year. You authorize PassengerGuard to charge the payment method used at the time of purchase for the renewal fee at the then-current rate.
To avoid renewal charges, you must cancel before the renewal date. No refunds are issued for partial periods.
(e) The “Lifetime” purchase is a one-time payment that grants access for the duration of the defined lifetime term.
(f) You may cancel your auto-renewing subscription at any time on your iPhone by:
- Opening “Settings”
- Tapping on “iTunes & App Store”
- Selecting your Apple ID
- Tapping “View Apple ID”
- Signing in if prompted
- Scrolling to “Subscriptions” and selecting the subscription
- Tapping “Cancel Subscription”
Access will continue until the end of the current billing period.
Please note:
These instructions are based on iOS 14 and may vary slightly depending on your OS version.
If purchased via Apple or Google Play, you must cancel directly through your respective account settings.
If your subscription was purchased through a third-party bundle, refer to that partner’s cancellation process.
(g) You agree to promptly update us with any changes to your payment information. You are responsible for all applicable charges, taxes, and subscription fees associated with your account.
2.2 DEVICE REQUIREMENTS
To access PassengerGuard, your smartphone or other device must meet certain minimum system requirements. These are listed on our Website and in the Google Play and Apple App Store product descriptions.
2.3 ORGANIZATIONS AND COMMUNITY ACCOUNTS
PassengerGuard is a consumer-facing service. However, organizations such as employers, universities, or healthcare providers (“Communities”) may provide access to the Products to their members.
In such cases, Community-specific terms may apply. If these differ from the general Terms, the Community-specific terms will supplement—but not override—these Terms unless explicitly stated.
2.4 CHANGES TO FEES AND BILLING
PassengerGuard reserves the right to modify its pricing, introduce new fees, or update existing ones at its sole discretion.
We will notify users at least 30 calendar days in advance of any changes.
If you do not agree to the new pricing, you may cancel your membership or subscription in your account settings or by contacting us at support@passengerguard.com.
3. CANCELLATION OF SERVICES
3.1 CANCELLATION BY YOU
(a) You may cancel a monthly subscription at any time. The cancellation will take effect at the end of the current billing period.
To cancel, email us at support@passengerguard.com.
(b) You may cancel a yearly subscription or lifetime purchase within our 30-day money-back guarantee. This allows you to cancel and receive a full refund within 30 calendar days of your initial payment by emailing us at support@passengerguard.com.
Only one refund per user is allowed. After a refund is granted, you will no longer be eligible for the 30-day guarantee on future purchases.
This guarantee does not apply to renewals or purchases made via the Apple App Store or Google Play Store.
(c) If you purchased a subscription through the Apple App Store, you can cancel auto-renewal by going to your iTunes account settings, selecting “Manage Subscriptions,” and selecting the subscription to cancel.
If you purchased through the Google Play Store, follow Google’s instructions for canceling subscriptions via your account settings.
3.2 CANCELLATION BY US
We may suspend or terminate your access to the Products without notice if you commit fraud or violate any part of these Terms.
This includes, but is not limited to, unauthorized copying or downloading of PassengerGuard’s text, audio, or video content.
3.3 PROMOTIONAL CODES
Any promotional code or offer provided by us cannot be combined with other current or past offers.
Introductory offers are only valid for new users unless otherwise stated.
Former or trial users are not eligible for introductory pricing.
Promo codes are not valid for corporate or community plans.
Unless otherwise specified, all promotional pricing applies only to the initial subscription term. Renewals will be billed at the standard rate in effect at the time of renewal.
4. PROHIBITED USE OF THE PRODUCTS
4.1 MISUSE OF SYSTEMS OR NETWORKS
You agree not to upload, post, email, transmit, or otherwise introduce any material that contains viruses, malware, or any other code, files, or programs designed to interrupt, damage, or limit the functionality of any software, hardware, or telecommunications equipment associated with the Products.
You agree not to interfere with or disrupt the servers or networks connected to the Products or violate any procedures, policies, or regulations of networks connected to the Products. Unauthorized access to the Products is strictly prohibited.
4.2 IMPERSONATION, HARASSMENT, ILLEGAL USE
You agree not to:
- Impersonate any other person while using the Products.
- Use the Products in an offensive, illegal, immoral, or harmful way.
- Violate any applicable law while using the Products.
4.3 ENFORCEMENT AND REPORTING TO AUTHORITIES
Violating this section may constitute a criminal offense under applicable law.
We reserve the right to report such violations to law enforcement authorities and will fully cooperate by disclosing your identity if required.
In the event of such a violation, your right to use the Products will immediately terminate without notice.
5. CONTENT PROVIDED THROUGH THE PRODUCTS
5.1 COPYRIGHT & OWNERSHIP
(a) All materials (including software and content, whether downloaded or not) included in the Products are the property of PassengerGuard (or its affiliates or third-party licensors, where applicable), unless otherwise stated.
You acknowledge and agree that these materials are valuable proprietary content and that you acquire no ownership rights except for the limited right to use them as expressly outlined in these Terms.
(b) Some materials made available through the Products may belong to third-party licensors. Such licensors have the right to enforce relevant sections of these Terms directly against you.
(c) Audio and video content provided by PassengerGuard that is not explicitly marked as downloadable may not be downloaded, copied, or saved from the Products or any device.
(d) The Products are intended for personal, non-commercial use only.
Unauthorized commercial use, including affiliate links, advertising, or resale of content, is prohibited and may lead to account termination.
You may not copy, redistribute, republish, or transmit any material without prior written permission from PassengerGuard.
(e) Some content may be marked as shareable (e.g., on social media). You are granted a limited license to display or share such “distribution content” through personal blogs or social channels.
You may modify the format (e.g., video resolution) only as technically necessary and without altering the meaning or quality of the original content.
You may not pair shareable content with false, harmful, misleading, or unlawful material.
(f) You may not download, display, copy, reproduce, modify, distribute, create derivative works from, or otherwise exploit content, code, data, or materials from the Products unless expressly permitted.
Unauthorized use may violate copyright laws and subject you to liability. PassengerGuard will enforce its intellectual property rights to the fullest extent of the law.
6. AVAILABILITY OF PRODUCTS
6.1 SERVICE LIMITATIONS
While we aim to provide the best possible experience, we do not guarantee that the Products will meet your expectations or be entirely error-free.
If you experience an issue with the Products, please contact us at support@passengerguard.com, and we will review your complaint.
If necessary, we may suspend access while resolving the issue.
We are not liable for any unavailability of the Products for a commercially reasonable period of time.
6.2 TEMPORARY DOWNTIME
Your access to the Products may occasionally be restricted for maintenance, updates, or the rollout of new features.
We will do our best to restore service as soon as possible.
If the Products become unavailable, our usual order and cancellation terms will still apply.
Please email us at support@passengerguard.com to make changes to your order if needed.
6.3 NO GUARANTEE OF RESULTS
While we strive to support you, we do not promise that using the Products will lead to any medical or psychological improvement.
You acknowledge that you assume all risk relating to the use, performance, and outcomes of the Products.
7. USER-GENERATED CONTENT
7.1 DEFINITION OF USER MATERIAL
The Products may allow you to submit content to us — such as photos, comments, videos, audio clips, or other input.
In these Terms, “User Material” refers to all public-facing content submitted by you, including text, images, files, sound, video, and creative works.
User Material does not include account details or product usage information submitted during registration or use.
7.2 ACCEPTANCE OF TERMS
By submitting User Material, you agree to do so in accordance with these Terms.
If you do not agree, please do not submit any content.
7.3 NO PRE-SCREENING OR GUARANTEES
We do not systematically monitor User Material and are not responsible for its legality, accuracy, or content.
Any opinions expressed in User Material are not necessarily endorsed by PassengerGuard.
We make no warranties, express or implied, regarding User Material.
7.4 RIGHT TO REMOVE OR RESTRICT ACCESS
We reserve the right to remove, edit, or block User Material at our sole discretion — especially if it violates these Terms.
We may do so without notice.
7.5 USE OF USER MATERIAL
We may:
- Combine your User Material with other content
- Use it internally for analytics or marketing
- Benefit commercially (directly or indirectly) from it
You acknowledge and accept this.
7.6 YOUR WARRANTIES WHEN SUBMITTING USER MATERIAL
By submitting content, you warrant that:
- (a) You own it or have the legal right to submit it
- (b) It is not unlawful, obscene, defamatory, threatening, harassing, hateful, or otherwise inappropriate
- (c) It does not promote products, services, or commercial activity
- (d) You have consent from any identifiable person in the material, or no one under 18 is identifiable
- (e) You will not collect personal data (e.g., emails, usernames) from other users
- (f) You will not engage in spamming, phishing, copyright infringement, or impersonation
- (g) You will not use automation or scripts to modify content or interact with the system
- (h) You will not access non-public areas of the app or systems without permission
- (i) You will not attempt to scan or exploit vulnerabilities in the Products or our systems
7.7 LEGAL LIABILITY & IDENTIFICATION
We may disclose your identity to any third party who claims that their rights have been violated by your User Material.
7.8 NON-CONFIDENTIALITY & LICENSE
User Material is not considered confidential. By submitting it, you:
- Grant PassengerGuard a perpetual, worldwide, royalty-free, non-exclusive license to use, copy, modify, display, publish, and distribute it
- Allow PassengerGuard to create derivative works and sublicense your content
- Acknowledge that you will not be paid or credited unless otherwise agreed
PassengerGuard has no control over how your content is used once published.
7.9 FEEDBACK & SUGGESTIONS
Any suggestions, ideas, or feedback you submit are considered non-confidential.
By submitting them, you grant us an unrestricted license to use them for any purpose without compensation.
8. LINKS TO OTHER WEBSITES
8.1 THIRD-PARTY LINKS AND SERVICES
The Products may contain links to third-party websites or services. You acknowledge that any access to such sites is entirely at your own discretion and risk.
PassengerGuard does not review or endorse third-party websites and is not responsible or liable for:
- (a) Their availability or accessibility
- (b) Their privacy policies or practices
- (c) Their content, products, advertising, or other materials
- (d) Any damages or losses that may arise from your use of or reliance on them
8.2 LINKING TO OUR WEBSITE
You may link to our homepage, provided that:
- The link is done in a fair and legal manner
- It does not damage or exploit our reputation
- It does not imply any form of endorsement or association unless authorized
You may not:
- Link from a website that you do not own
- Frame the Products on another site
- Create deep links to specific pages or functions without written permission
We reserve the right to withdraw linking permission at any time.

9. DISCLAIMER OF LIABILITY FOR THE PRODUCTS
The information provided within the Products is for general informational purposes only.

- The completeness, accuracy, reliability, suitability, or availability
- Of the Products or the information contained within them
- For any purpose
Any reliance you place on such information is strictly at your own risk.
If you experience issues with your mental or physical health, we strongly encourage you to consult a qualified medical or psychological professional before using our Products.
10. MEDICAL DISCLAIMER
10.1 GENERAL DISCLAIMER
PassengerGuard provides digital content related to health and wellness.
We are not a healthcare provider, therapist, or licensed medical service, and our Products must not be considered medical advice.
Only your doctor or licensed healthcare provider can give you such advice.
While third-party research suggests that the exercises and information provided by PassengerGuard may support prevention and recovery from anxiety and panic attacks, PassengerGuard makes no claims, guarantees, or warranties regarding therapeutic outcomes.
10.2 INFORMATION FOR CONVENIENCE ONLY
All health-related information and links made available through the Products — whether provided by PassengerGuard or third-party partners — are provided for your convenience only.
10.3 NOT A SUBSTITUTE FOR PROFESSIONAL CARE
Any guidance, suggestions, or content provided in the Products are for general informational purposes only.

11. END USER LICENSE AGREEMENT (EULA)
11.1 LICENSE GRANT
Subject to this License Agreement and the Terms set forth herein — and upon payment of applicable subscription fees — PassengerGuard grants you a limited, non-exclusive, revocable license to stream, download, and use the Products for personal, non-commercial purposes only.
11.2 OWNERSHIP OF INTELLECTUAL PROPERTY
The Products contain copyrighted material and proprietary content owned by PassengerGuard or its licensors.
All rights, titles, and interests in the Products remain the sole property of PassengerGuard or its licensors.
You are granted a license, not ownership, and you may only use the Products in accordance with this agreement.
11.3 RESTRICTIONS ON USE
You agree not to, and not to assist or permit any third party to:
- (a) Copy, store, reproduce, transmit, modify, reverse-engineer, emulate, decompile, or disassemble the Products
- (b) Use the Products or any part of them to build a competing application or tool
- (c) Rent, lease, lend, publicly display, sell, or distribute the Products
- (d) Tamper with or bypass any security or digital rights management systems
- (e) Circumvent geographical restrictions applicable to the Products
- (f) Use the Products in violation of this agreement or any applicable law
11.4 NO PUBLIC PERFORMANCE RIGHTS
You may not publicly perform, broadcast, or otherwise distribute the Products.
All content remains the intellectual property of PassengerGuard or its licensors and is to be used only under the permissions granted herein.
12. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) NOTICE
12.1 COPYRIGHT COMPLIANCE
PassengerGuard is committed to complying with copyright laws and expects users to do the same.
You may not store or distribute content on the Products in a way that violates third-party intellectual property rights.
If you are a copyright holder in the United States and believe your rights have been infringed, you may submit a claim under the Digital Millennium Copyright Act (DMCA).
PassengerGuard reserves the right to terminate the accounts of repeat infringers.
12.2 REPORTING A COPYRIGHT VIOLATION
If you believe your copyrighted work has been copied or published in a way that constitutes infringement, please contact our designated DMCA agent with the following information:
- (a) A physical or electronic signature of the copyright owner or authorized agent
- (b) A description of the copyrighted work that has been infringed
- (c) The location (URL) of the allegedly infringing material
- (d) Your name, address, telephone number, and email address
- (e) A statement that you believe in good faith that the disputed use is unauthorized
- (f) A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf

13. GENERAL TERMS
13.1 ASSIGNMENT
PassengerGuard may transfer its rights and obligations under these Terms to another company or legal entity at any time, provided your rights are not materially affected.
You may not transfer your rights or obligations to another party without written permission.
These Terms are personal to you. No third party shall have any rights under them, unless explicitly stated.
13.2 INDEMNIFICATION
You agree to defend, indemnify, and hold harmless PassengerGuard, its directors, officers, employees, contractors, and affiliates from and against all claims, liabilities, damages, losses, and expenses — including legal fees — arising out of your use of the Products or violation of these Terms.
PassengerGuard reserves the right to assume exclusive defense of any matter otherwise subject to indemnification and you agree to cooperate in such defense.
13.3 WARRANTIES & LIMITATIONS
(a) We warrant that any product purchased from us will, upon delivery, match its description and be of satisfactory quality.
(b) We warrant that we will provide the Products with reasonable care and skill throughout your subscription period.
(c) Nothing in this section excludes liability for fraud, death, or personal injury caused by negligence, or where liability cannot be excluded by law.
(d) The Products are provided “as is.” We make no express or implied warranties, including fitness for a particular purpose or uninterrupted access.
(e) Any implied warranties under law are excluded to the maximum extent permitted.
13.4 NO WAIVER
Failure by PassengerGuard to enforce any right under these Terms shall not constitute a waiver of that right or any others.
13.5 FORCE MAJEURE
We are not liable for delays or failure to perform caused by events beyond our reasonable control.
13.6 INTERPRETATION
Unless the context requires otherwise:
- Words such as “including” or “for example” are not limiting.
- Singular terms include the plural, and vice versa.
13.7 ELECTRONIC COMMUNICATIONS
(a) By using the Products, you consent to receive communications electronically (via email or app notification), and acknowledge that electronic contracts, notices, and disclosures satisfy any legal requirement that such communications be in writing.
(b) You may request paper copies of any communication by emailing us at support@passengerguard.com. We may charge a reasonable service fee.
(c) System Requirements: To access and retain electronic records, you must have a compatible device, browser, and internet connection.
(d) You may withdraw consent for electronic communication at any time. If you do, we reserve the right to terminate your access to the Products.
13.8 NOTICES
Unless otherwise stated, legal notices must be sent to:

Notices sent by us to your registered email are deemed received upon sending.
13.9 ENTIRE AGREEMENT
These Terms, along with referenced policies, constitute the entire agreement between you and PassengerGuard, and supersede any prior negotiations or understandings.
No party relies on any representation not set out in these Terms.
Nothing in this clause limits liability for fraud.
13.10 THIRD-PARTY RIGHTS
Except as stated in Section 12 (DMCA), no third party has any rights under these Terms.
13.11 LIMITATION OF LIABILITY
(a) We will use reasonable efforts to correct errors in the Products.
Our liability is limited to the amount paid for your subscription.
(b) We are not liable for:
- (i) Technical errors or data delays during registration or payment
- (ii) Any virus or malware that may infect your device through use of the Products
- (iii) Any external websites linked from the Products
(c) To the fullest extent allowed by law, PassengerGuard and its partners, affiliates, or licensors are not liable for:
- Consequential, exemplary, or indirect damages
- Loss of data, revenue, or goodwill
- Any claim exceeding the total amount you paid to PassengerGuard
13.12 SEVERABILITY
If any provision is found invalid or unenforceable, it shall not affect the validity of the remaining provisions.
